Our Terms of Service

The Company

Code Rev Kids, Inc. (the “Company”) refers to Code Rev Kids, Inc. as well as their affiliates and subsidiaries (collectively "Code Rev Kids", "CodeREV", “we”, “us”, “our”, or the “Company”).

The Service

Our Service teaches kids how to code, develop digital art, and other STEAM topics, using software, products, and programs designed by Code Rev Kids, Inc., specifically for kids, including but not limited to the use of our websites kidslovecode.com and coderevkids.com coderevkids.com, programs offered on our websites, virtual experiences via Code Rev Kids platforms or third-party platforms, and/or in-person events (collectively and individually the “Service”).

Refunds & Cancellations

All sales are final. However, full credits of equal value to the amount you have paid (not cash refunds) will be granted for use on any classes and camps offered by Code Rev Kids, Inc. in all cases where requests are made at least 1 week before your registered class or camp. Refund requests on all sales will be considered on a case-by-case basis and granted at the sole discretion of Code Rev Kids, Inc. Refunds (money paid back to you) are typically only granted in cases where a credit to your balance on classes, camps, and products is not possible for you to use, when requested at least 3 weeks prior to camp/class start dates. In order to request a credit or a refund, send an email with the subject “Credit Request" or "Refund Request” to register@coderevkids.com stating the dates of your scheduled session and reason for your request.

Rescheduling & Canceling

If you would like to reschedule or cancel a registered session, you can do so by emailing us at register@coderevkids.com at least 1 week before your scheduled class to receive a full credit of equal value for your missed class or session, which will be granted to use for one calendar year from the date of your registered session. If you do not reschedule or cancel one week before your registered session and you miss your registered session, then the session will only be credited at Code Rev Kids, Inc's discretion on a case by case basis.

Your Account

To register a Code Rev Kids account, you must be at least eighteen (18) years old and a parent/legal guardian of any minors whom you add to your account. You are responsible for any and all actions using your account; therefore, you agree to maintain confidentiality of your account, including but not limited to restricting access to your devices and password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization, or any name that is offensive, vulgar, or obscene. Company will not be responsible for any liabilities, losses, or damages arising out of the unauthorized use of your account or any public display or misuse of your user content. Company does not, and cannot, prescreen or monitor all user content.

Representation

You acknowledge that you have the authority to agree to these Terms as a parent or guardian on behalf of the kids set forth by you under your account (“your kids”).

Our Communications

For contractual purposes, you consent to receive communications from Code Rev Kids, Inc. in electronic form to the email address that you have submitted, and agree that all Terms, agreements, notices, disclosures, and other communications that Code Rev Kids, Inc. provides to you electronically satisfy any legal requirement that such communications would satisfy if they were in writing. The foregoing does not affect your nonwaivable rights. We may also use your email address to send you other messages, including information about Code Rev Kids, Inc. and special offers. You may opt out of such email by changing your account settings or sending an email to register@coderevkids.com.

Indemnification

You agree to release, defend, indemnify, and hold harmless Code Rev Kids, Inc, and its licensees, licensors, employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorneys’ fees), resulting from or arising out of your use and access of the Service, by you or any person using your account and/or breaching these Terms. If you have a dispute with one or more users of the Service or a third-party merchant of a product or service, you agree to release Code Rev Kids, Inc. (and its officers, directors, agents, subsidiaries, joint ventures, and employees) from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE SERVICE INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, SECURITY, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, COMPANY MAKES NO WARRANTY OR REPRESENTATION THAT ACCESS TO OR OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ASSUME FULL RESPONSIBILITY AND RISK OF LOSS RESULTING FROM YOUR DOWNLOADING AND/OR USE OF FILES, INFORMATION, CONTENT, OR OTHER MATERIAL OBTAINED FROM THE SERVICE.

Governing Law & Dispute Resolution

In the unfortunate event of any controversy or claim arising out of or relating to these Terms and your use of the Service, you agree that we will attempt to resolve any dispute through amicable, confidential negotiation amongst the parties. If the matter is not resolved by negotiation, then the dispute shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The prevailing Party in any such dispute is entitled to recover its reasonable fees and costs, including without limitation reasonable attorneys’ fees. Any judgment under this section is fully enforceable in your country and state of residence. THE PARTIES EXPRESSLY WAIVE THE RIGHT TO A JURY TRIAL IN ANY ACTION RELATING TO THIS AGREEMENT.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
